Waiver, Release, & Assumption of Risk Form For Coaching with Evan Nystrom

This form is an important legal document. It explains the risks you are assuming in participating in an exercise program with Evan Nystrom. It is very important that you read and understand it completely. After you have done so, please print your name legibly and sign in the spaces provided below. If you have any questions or concerns, please ask Evan Nystrom prior to signing. Waiver, Informed Consent, and Covenant Not to Sue: I, The Client, wish to voluntarily participate in an exercise program under the direction of Evan Nystrom via personal training and coaching, which may include, but may not be limited to, weight and/or resistance training. In consideration of Evan Nystrom agreement to instruct, assist, and train me. I hereby forever release and discharge, and hereby hold harmless, Evan Nystrom, and the respective agents, heirs, assigns, contractors, and employees from any and all claims, demands, damages, rights of action or causes of injuries resulting therefrom. THIS WAIVER AND RELEASE OF LIABILITY INCLUDES, WITHOUT LIMITATION, INJURIES WHICH MAY OCCUR AS A RESULT FROM (1) EQUIPMENT THAT MAY MALFUNCTION OR BREAK; (2) AND SLIP, FALL, DROPPING OF EQUIPMENT; (3) NEGLIGENT INSTRUCTION OR SUPERVISION; AND/OR (4) ANY MISUSE OF UNSUPERVISED USE OF ANY EQUIPMENT IN YOUR HOME. Assumption of Risk: I, The Client, recognize that exercise might be difficult and strenuous and that there could be personal risks and dangers inherent in my undertaking a program of exercise. I acknowledge that the possibility of certain and usual or unusual physical conditions during exercise does exist. These physical conditions may include, without limitation, increased heart rate and stress, and in extreme cases, abnormal blood pressure; fainting; disorders in heartbeat; heart attack; and, in rare instances, death. I understand that as a result of my participation, I could suffer an injury or physical disorder that could result in me becoming partially or totally disabled and incapable or performing any gainful employment or having a normal social life. I recognize that I must obtain permission from my physician prior to involvement in this exercise program. My physician shall be informed of any pre-existing physical issues or conditions and shall be asked if the type of exercise program provided by Evan Nystrom is appropriate for me. Evan Nystrom is available to consult with medical personnel regarding their training programs and protocols. If I have a physical limitation or other health risk factors, I agree to provide Evan Nystrom or contractors with full disclosure of such issues prior to starting my exercise program. If, at any time, an aspect of an exercise program becomes uncomfortable or overly strenuous, I will inform Evan Nystrom or contractors of such issues. I acknowledge and agree and I assume the risks associated with my personal health condition and risk factors and any and all activities and/or exercises in which I shall participate. I ACKNOWLEDGE THAT I HAVE THOROUGHLY READ THIS WAIVER, RELEASE, AND ASSUMPTION OF RISK FORM AND FULLY UNDERSTAND THAT IT IS LIABILITY. BY SIGNING THIS DOCUMENT, I AM WAIVING ANY RIGHT I OR MY SUCCESSORS HEIRS OR ASSIGNS, MIGHT HAVE TO BRING A LEGAL ACTION, OR ASSERT A CLAIM, AGAINST EVAN NYSTROM OR OTHERS REFERRED TO IN THIS DOCUMENT FOR ANY NEGLIGENCE. Photography and Audio/Video Recording: I hereby give Evan Nystrom permission to videotape, photograph, and record my image or my likeness. I understand and agree that such taping or recording may be used at the sole discretion of Evan Nystrom, and recordings may be used by Evan Nystrom, or their assigns, for any purpose, commercial or otherwise, worldwide, and in perpetuity, without compensation to me. I also understand by giving my permission is in no way an endorsement of Evan Nystrom or any product(s) distributed by Evan Nystrom. By signing this document, I agree that I have either obtained the advice of legal counsel or have knowingly and willingly waived such right by failing to do so. This verifies that all the information above is true to the best of your knowledge and I (the client) understand that exercise can be dangerous. This also verifies that by signing this that Evan Nystrom is not at fault of any injury, illness, or death that may occur with exercise.
